The Court of Reggio Emilia judgement of July 5, 2016 stated on the content of law No. 3 of 2012 on debt restructuring.
More in particular, in assessing the criteria and conditions required for the debt restructuring plan, stressed the importance of the art. 12 of the preliminary provisions.
This would have empowered the Court to withdraw the decree and to reject the agreement once acts or attempts in fraud of creditors emerge.
